Item not shipped, trying to get full refund

Hello everybody,

 

I bought an item on Ebay in August. We were supposed to receive it between the Nov 10th and Nov24th. No news so i decided to contact the seller to have an idea of when they'll ship the item before  before Nov 10th. No news from the seller. Contacted the seller again after the time range. Still no news. I decided to open a case ''item not shipped'' with Ebay and even after the 4 days, no news from Ebay. My case is still under review. So now, im contacting them through the live chat and they accept a refund but its not the full price of the article. If i ask ebay to step in, they say my case in still under review.

What should i do?

sounds like a pre-order item...risky at best ...and there are never any gurantees of anything...

Did you get a good sense of trustworthiness about this seller by reading up on this seller's feedback/reviews prior to ordering?

being at the mercy of honesty and transparency of a seller, you are learning a hard lesson that not everything "goes according to Hoyle"....
