The information the shipper has is the last time the shipment was recorded, not where it is at the moment.
Does the tracking show that it has passed Canadian Customs?

Has that date passed?
If so, open a Claim and get your money back.
This does not affect the seller.
And when the purchase arrives, neither eBay nor the shipper wants it back. It's yours.
