It probably doesn't matter. Trump will just use some other reason to enact them and that'll get tied up in the courts for a year or two and so on. Or he'll simply ignore the courts and dare them to do something about it. Congress could probably also pass something that says he was acting with their approval (if it came down to repaying a trillion dollars or doing that, it's not hard to imagine which they'd have to choose).
