Are you getting the impression the block is attached to the category vs the actual item? Stamp and currency sellers are in a similar boat.
According to the screenshot not seeing Tobaciana or your dishwear categories. The cosmetics when flammable is. Possibly AI in use with bad parameters?

What about other countries? I'm not clear on whether this is a US-specific exclusion or not.

By not visible with EIS do you mean that your listings do not show on .com results, or that they do but EIS is not shown as an active option for US shipping?

Your "dishware" is in the "Collectibles & Art" category so that might be why it's showing differently than @cottagewoman 's items.
Maybe the assumption is that if it's in the Collectibles category then it isn't to be used for drinking purposes, and therefore doesn't have the FDA hoops that need to be jumped through. Just spitballing here of course.
